Photographer or videographer ("Content Provider"), grants you a non-exclusive perpetual personal use license to download and copy the accompanying image(s) or video(s), (collectively "Media,") subject to the following restrictions:
*As a benefit to photography clients, the Studio/Photographer offers this license for those who wish to have an image printed on their own by a lab of their choice. "Print" refers to the hard, physical form of an image. This license grants the client the right to make prints, canvases, t-shirts or other printed merchandise, from a high resolution file, ready for print and for personal use only. Printing rights are subject to the terms of the "Personal Use License" stated above. A per-image licensing fee will be required to release a high-resolution, printable copy (file) of the image, unless included in session/package. A copy of this license must accompany each file to be presented for print, as labs will not duplicate copyrighted material. This license does NOT include any printing of images for Commercial purposes. It will be at the discretion of the Studio/Photographer as to which file(s) (if any) will be offered or made available to use this license. Studio/Photographer is not liable for, nor will assist with color profile issues, cropping issues or any damages caused by the client's printing company, or any damages associated with the use of this license. All portrait session images, either included and/or purchased files and physical prints, will come with a "Personal Use License" and, in the case of digital files, a "Print License" (physical photographs can NOT be duplicated).
People acting in a personal capacity are welcome to share (by clicking a "share button" or using shareable files given to photography clients) our photographs on blogs, web pages, and social media accounts (such as Facebook and Instagram) without prior permission, provided that all images are accompanied with a credit link to the Photographer or Photographer's website. Social Media Rights are subject to the terms of the "Personal Use License" stated above. Failure to attribute an image properly may result in a take-down notice to the web host
Images may be licensed for commercial use via the links below each image in the galleries. If you are ordering multiple images, or would like a rights-managed contract, we do offer discounts. We also offer discounts to our web design clients (current or past) who need images for their websites. Email us (This email address is being protected from spambots. You need JavaScript enabled to view it.) with the details of your project. Examples of commercial use include: company web pages, product labels, books, merchandise, magazines, most apps, brochures, business cards, company portraits and educational products. If you are interested in an image that does not have links, we are either unauthorized to resale the image or unwilling to allow the commercial use of the image. Please contact us with the details, as it may be an oversight during an upload.
License fees vary depending on the use, but generally fall between $100 and $400 per image. License arrangements for less than $400 must use the automated online system (all others will be invoiced).
We also offer web graphics/logo design for business/websites. Please email us for a quote.
Registered non-profit organizations may be able to license our work at discounted rates, or free of charge, depending on the context of use. Contact us for an estimate; prior permission is required.
Educational classroom use by students, teachers, and researchers is free of license fees, strongly encouraged, and does not require prior permission as long as the use does not involve uploading images to the internet. If the project involves posting our photographs to the internet, prior permission is required and images must be accompanied by a visible photo credit and a link back to kampoc.com. Citing sources is good academics, after all!
We do not allow our work to be used in projects involving uploads to sites that apply a blanket Creative Commons license. This means our photographs cannot be used on Wikipedia, Wikispaces, and other similar sites.
We do not allow students to use full, or any part of our photographs to make composites or any other works, or alter our photographs in any way. All photographs used for classroom use will adhere to the terms of our "Personal Use License" (stated above).
Use of our photographs in the scientific literature is considered commercial use and requires a paid licensing agreement.
We do not allow our images to be used in press releases without a full rights-transfer. Transfers can be purchased for a limited selection of unpublished photographs, starting at $500/image.
Use of our photographs in social media (Facebook, blogs, Twitter, Instagram etc.) by commercial entities is the same as "Commercial Use" (above) and requires a licensing agreement.
Prior permission is required to copy all or parts of our photographs in derivative artworks. Some adaptations we may consider to be Fair Use, others will require a formal licensing agreement. The only way to be sure is to ask.
(see also "Copyright Statement" for further information not listed below)
Unfortunately, we contend with copyright infringements every year. It has become common practice to screenshot and/or download images from the internet, without checking for copyrights, and using them (or parts of them) however one chooses, without consideration or regard. We have implemented the following policy in an attempt to maintain control over our work:
NOTICE OF COPYRIGHT: It is ILLEGAL to copy or reproduce any photographs or videos elsewhere without Studio's/Photographer's permission, and violators of this Federal Law will be subject to its civil and criminal penalties. Studio/Photographer reserves the right to not have their works misrepresented, including, but not limited to, negligence on the client's/person's part. Clients and any member of the public (referred to as, "person") MAY NOT alter or manipulate delivered (or any) photographs/files in any way, including, but not limited to: social media filters, color to black and white/chromatic conversions, social media stickers or imprinted messages directly on images, removal of watermarks, color modification, digital modifications, background changes, cropping, resizing, resolution conversion, removal of copyright, altering metadata or defamatory presentation (including memes). While sharing on websites or social media is acceptable (with credit to the photographer), client/person may not present delivered (or any) galleries/files/photographs/videos/slideshows in a way that suggests that the client/person is the copyright holder, media creator or photographer, such as entering a photograph/video in a contest, using a photograph/video for financial gain (including featuring on business websites), and, but not limited to, transferring a video/photograph to a third-party. Client/person may NOT post publicly screenshots of any images in the client's online gallery, slideshows or previews, as the quality of such screenshots may be a misrepresentation of the Studio's/Photographer's image quality and brand. *Clients: A complimentary watermarked web-sized file will accompany all included and/or purchased digital files, to be used for the purposes of social sharing.
